Does Florida Recognize Common Law Marriages?
A common law marriage is when two heterosexual individuals live together in the same house for a considerable amount of time. This is accepted as a lawful relationship in many states of the United States of America. |
However, the couple needs to abide by all the distinguishing features common in a legal marital relation. The female partner needs to use her male partner’s last name when signing leases or mortgages under both their names and filing joint tax returns.
There are many ways to find out if a couple has been living together and they have strong intentions of marrying each other in the near future. If this couple resides in a state where the common law is in effect, then the couple would need to go through a formal separation when they decide to end their relationship. Common law marriage is recognized only by a handful of States in the America. In fact, majority of the States do not accept it as a legal form of marriage.
Florida joins with the majority of the states and does not accept common law marriages. Even if a couple has been living together for several years, their arrangement is not considered legal in Florida. A marriage has to be solemnized legally or by clergy for it to be accepted by the laws of the State of Florida.
However, in some places like Washington DC, Colorado and California the common law marriage is accepted. It really makes a difference when the couple decides to separate their ways after co-habiting for some time. When a woman or man has been living together in this form of relationship and has invested in material goods and decide to separate, then the common law of marriage appears to be more beneficial. This is because when it comes to separation procedures the legal ways give them a fair trial or settlement of assets.
Florida is still among the top states for a wedding reception. It is a favorite spot for tourists and couples on their honeymoons for the beautiful and picturesque locales. Therefore, the state authorities do not feel it would be wise to accept common law marriages.
